Reflecting Trial Impressions in Real-Time
Description:

  • The Jury Trial Consultants will recruit 3 to 6 jury-eligible citizens from the venue who best mirror the characteristics of the actual jury
  • Generally, we recruit and qualify a pool of 8 to 12 prospective shadow jurors and eliminate shadow jurors during voir dire to best simulate the actual jury
  • The Jury Trial Consultants orient the shadow jurors to the rules and regulations prohibiting contact with trial counsel, actual jurors, media or engaging in case-related discussions among themselves
  • Shadow jurors will attend all sessions of the trial that are observed by the actual jury
  • The Jury Trial Consultants will shepherd the shadow jury during breaks and meals, at which times impressions are surveyed and any critical issues are transmitted to counsel (via Blackberry or alternative mobile device)
  • The Jury Trial Consultants will conduct nightly interviews of each juror, condense the interview findings and provide nightly reports to counsel

  4. This immediate feedback loop allows counsel provides counsel with real-time insights about what is influencing juror impressions of the case
  5. Counsel can make adaptive, strategic decisions during trial
  6. Parties and stakeholders are provided real-time information enabling informed decisions about exposure and potential damages awards during trial

Work Product (Deliverables):

  1. Nightly interviews with shadow jurors
  2. Daily shadow juror written impressions about impressions, comprehension, witness testimony reactions
  3. Video of Shadow Jury deliberations (conducted early to allow counsel to utilize the feedback in formulating strategic closing arguments)
Costs:
Professional Fees – $4,000 for setup and $3,000 per trial day, plus Collateral Expenses*
*Collateral Expenses include, but are not necessarily limited to, the costs of shadow juror incentive fees, shadow juror recruiting and screening, shadow juror data entry, facility fees, audiovisual costs, meals and (if applicable) reasonable consultant travel expenses.  These charges vary according to project scope and geographic location.  Please request a proposal to obtain a quote including itemized collateral cost estimates.

Scheduling and Required Lead Time
We require approximately three (3) weeks of lead notice for purposes of recruiting jurors and coordinating the research.
