Trial Simulations and Mock Juries
Description:

  • Mock Trial jury research exercises incorporate witness testimony and separate opening and closing arguments
  • Mock Trials are a form of trial simulation that allows for more extensive witness testimony
  • Witness testimony can be either live or via videotape (e.g., video depositions)
  • Mock jurors are randomly selected, screened for security issues, and then qualified as jury-eligible citizens from the venue
  • 30-minute opening and 30-minute closing arguments, case presentations from attorneys representing the parties
  • Mock jurors respond individually to questionnaires before hearing anything about the case, then following the testimony from each witness, and again following attorney closing presentations.  Mock jurors are then broken into groups and instructed to deliberate.
  • Mock Trials typically run between 6 to 8 hours
  • Deliberation groups consist of 6 to 8 jurors per group (12 jurors for criminal cases)
  • 1 to 4 separate Mock Trial deliberation groups can be conducted in one day

Insight and Advantages:

  1. A randomly-selected, representative cross-section of citizens from the venue provide feedback about your case
  2. Individual juror questionnaire data is recorded for jury profiling and jury selection purposes
  3. The Jury Trial Consultants moderate a focusing session following deliberations to examine how jurors arrived at their decisions
  4. Mock Trials better track the ebb and flow of jurors’ reactions to the presentations
  5. For cases with high complexity or extensive witness testimony the Mock Trial format allows more time to present information to mock jurors
  6. Witness testimony is rated by mock jurors across multiple dimensions
  7. The mock trial structure allows time for testimony from multiple independent defendant parties

Work Product (Deliverables):

  • A comprehensive report profiling mock juror case perceptions, perceived strengths and weaknesses, individual and group verdict and award decisions.
