Research Utilizing Actual Arbitrators and Judges
Description:
- The purpose the mock arbitration or mock bench trial is to submit the case story for evaluation and refinement under simulated trial conditions with several well-informed surrogate triers of fact
- The Jury Consultants trial consultants have conducted several mock arbitration and mock bench trials over the last two decades, including high technology patents and complex financial and securities matters.
- The Jury Trial Consultants recruits a sample of prospective judges/arbitrators who best approximate the characteristics, tenure, and subject-matter expertise of the actual panel
- The trial team selects the final surrogate judges/arbitrators from the list of prospects
- Arbitrators/judges listen to arguments regarding the issues and claims for each side of the case (an informed member of the trial team will aggressively portray the opposition’s positions)
- The Jury Trial Consultants administer surveys on key strengths and weaknesses after each presentation
- The arbitrators/judges render individual decisions on all claims and provide rationale for their judgments (via questionnaire)
- The entire panel then openly deliberates about the issues
- After deliberations, The Jury Trial Consultants moderate a focus session of key evidence and issues with the arbitrators/judges followed by a Q & A session with counsel

Work Product (Deliverables):
- A comprehensive report detailing the case perceptions, argument impressions, opinions regarding the evidence, rationale and decisions of the judges or arbitrators.
- Digital video recording (DVDs) of all group deliberations
Professional Fees: $22,500, plus Collateral Expenses*
*Collateral Expenses include the costs of, but are not necessarily limited to facility fees, administration fees, search costs, judge/arbitrator hourly fees ($350-$600), audiovisual costs, meals and reasonable travel expenses. These charges vary according to project scope and geographic location.
